Court Dismisses Plea Seeking Ban on PM Modi from Contesting Elections

The Delhi High Court has dismissed a plea seeking the disqualification of Prime Minister Narendra Modi from contesting elections, deeming it “thoroughly misconceived.” The plea alleged violations of the Model Code of Conduct during an election rally in Uttar Pradesh, calling for a six-year ban. However, the court stated it cannot direct the Election Commission’s stance on the matter.

Advocate Siddhant Kumar, representing the Election Commission, assured that the complaint would be duly processed and addressed. The petitioner had claimed that PM Modi made religious references during an election rally in Pilbhit, Uttar Pradesh, on April 9. The Prime Minister’s remarks about Hindu and Sikh deities were scrutinized for their compliance with the model code of conduct.

PM Modi’s statements during the rally, particularly regarding the INDIA bloc parties and their stance on the construction of the Ram Temple in Ayodhya, were cited in the plea. The court emphasized that while the petitioner had approached the Election Commission, the commission holds the authority to independently evaluate the complaint and take appropriate action.

The plea underscores the importance of adhering to the Model Code of Conduct during election campaigns, emphasizing the need for political leaders to refrain from making divisive statements that may incite religious sentiments. The court’s dismissal of the plea highlights the judicial stance on matters pertaining to electoral conduct and the role of the Election Commission in addressing complaints of misconduct.

This development adds to the ongoing discourse surrounding electoral ethics and the responsibility of political leaders in upholding the integrity of the democratic process. As India gears up for future elections, such cases serve as reminders of the significance of fair and transparent electoral practices.
